In August 2018, K Voy (the claimant) started working as the weekend concierge at Swan Lodge, a hostel run by Salvation Army Trustee Company Limited (the respondent). She left her position in March 2019 but started relief work on a zero-hours contract for the respondent in July 2019, doing between three and five shifts per week.

She became pregnant, and when a permanent assistant support worker role became available, she applied. She was not successful in her application for the role and brought a discrimination claim against the respondent for unfavourable treatment, stating that she was not genuinely considered for or offered the full-time position because she was pregnant or about to go on maternity leave. This is unlawful under section 18 of the Equality Act 2010.
