An employment appeal tribunal has dismissed a barrister’s appeal that LGBTQ+ charity Stonewall persuaded a legal firm to discriminate against her based on her gender-critical beliefs.
Allison Bailey, founder of unrelated charity the LGB Alliance, had accused Stonewall of instructing, causing or inducing her employer Garden Court Chambers (GCC) to discriminate against her over her view that sex is biological and cannot change, a belief protected under the Equality Act 2010.
Bailey won her original case against GCC in 2022, when an employment tribunal (ET) ruled that her former employer had discriminated against her because of her gender-critical beliefs.
But the tribunal dismissed Bailey’s claim against Stonewall, which she appealed.
This week, the employment appeal tribunal dismissed Bailey’s case against Stonewall.
“I perceive no error of law in the ET’s decision and the appeal will therefore be dismissed,” the employment appeal tribunal judgment reads.
Bailey and LGB Alliance disappointed
Bailey said she was disappointed with the result.
“I will now consider next steps carefully with my legal team,” she said.
“In the meantime, thank you to everyone who has supported me.
“I am very sorry that we have been unable to prevail on this occasion.”
LGB Alliance said in a statement: “We are very disappointed that Allison Bailey has not succeeded in her appeal and commend her for the enormous courage and fortitude she has shown throughout this ordeal.
“We await her decision about how she intends to proceed and send love and support from the whole team.”
Stonewall has yet to respond to Civil Society’s request for comment.
