The British Heart Foundation (BHF) has filed to overturn a ruling that ordered the charity to compensate an employee for being unfairly dismissed.
BHF was ordered to pay claimant L Thomas after an employment tribunal found they were “unfairly dismissed for making a protected disclosure”.
The total compensatory award was £2,358 for a period of seven weeks’ net loss of wages, and BHF was ordered to pay the sum on or before 17 October.
BHF: ‘We can robustly defend the claim’
The judgment states that BHF, as the respondent, failed to present a valid response on time, and the tribunal therefore “decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure”.
BHF told Civil Society it submitted an application for revocation of the judgment on 22 October.
A spokesperson said: “The employee failed their probationary period and left the BHF following a full HR process.
“The claim form for the employment tribunal was not sent to our registered office address, so we were unaware of the claim until after a judgment had been made in our absence.
“We have already applied to the tribunal for the judgment to be overturned so that we can contest the claim.
“We are confident that we dealt with this matter thoroughly and that we can robustly defend the claim.”
